{"id":922,"date":"2019-05-29T11:06:46","date_gmt":"2019-05-29T14:06:46","guid":{"rendered":"https:\/\/vvfconsultores.com.br\/blog\/?p=922"},"modified":"2020-01-04T01:07:14","modified_gmt":"2020-01-04T03:07:14","slug":"receita-federal-cria-obrigacao-acessoria-sobre-operacoes-realizadas-com-criptoativos","status":"publish","type":"post","link":"https:\/\/vvfconsultores.com.br\/blog\/receita-federal-cria-obrigacao-acessoria-sobre-operacoes-realizadas-com-criptoativos\/","title":{"rendered":"Receita Federal cria obriga\u00e7\u00e3o acess\u00f3ria sobre opera\u00e7\u00f5es realizadas com criptoativos"},"content":{"rendered":"<p>Atrav\u00e9s da publica\u00e7\u00e3o da Instru\u00e7\u00e3o Normativa n\u00ba 1.888\/2019, a Receita Federal instituiu a obrigatoriedade de prestar informa\u00e7\u00f5es relacionadas \u00e0s opera\u00e7\u00f5es praticadas com criptoativos \u00e0 Receita Federal.<\/p>\n<p>Al\u00e9m de estabelecer as situa\u00e7\u00f5es nas quais as informa\u00e7\u00f5es devem ser transmitidas, essa Instru\u00e7\u00e3o Normativa tamb\u00e9m abordou o conceito da <em>exchange<\/em>, sendo esta \u201c<em>a pessoa jur\u00eddica, mesmo que n\u00e3o financeira, que oferece servi\u00e7os referentes a opera\u00e7\u00f5es realizadas com criptoativos, inclusive intermedia\u00e7\u00e3o, negocia\u00e7\u00e3o ou cust\u00f3dia, e que pode aceitar quaisquer meios de pagamento, inclusive outros criptoativos<\/em>\u201d.<\/p>\n<p>Dessa forma, as pessoas f\u00edsicas e jur\u00eddicas residentes ou domiciliadas no Brasil dever\u00e3o enviar informa\u00e7\u00f5es ao Fisco sempre que:<\/p>\n<ul>\n<li>Praticar opera\u00e7\u00f5es cujo valor isolado ou conjunto ultrapasse R$ 30.000,00 (trinta mil reais) quando n\u00e3o forem realizadas em <em>exchange<\/em> ou tenham sido realizadas em <em>exchange <\/em>domiciliada no exterior; ou<\/li>\n<li>Realizar opera\u00e7\u00f5es de compra e venda, permuta, doa\u00e7\u00e3o, transfer\u00eancia do criptoativo para a <em>exchange<\/em>, bem como qualquer outra que resulte na transfer\u00eancia desses criptoativos.<\/li>\n<\/ul>\n<p>Essas informa\u00e7\u00f5es dever\u00e3o ser transmitidas a partir do m\u00eas de setembro, com a rela\u00e7\u00e3o das opera\u00e7\u00f5es praticadas no m\u00eas de agosto.<\/p>\n<p>A falta de envio dessa obriga\u00e7\u00e3o sujeita o contribuinte a aplica\u00e7\u00e3o de penalidades e o Minist\u00e9rio P\u00fablico Federal poder\u00e1 ser comunicado caso existam ind\u00edcios da pr\u00e1tica de crimes.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Atrav\u00e9s da publica\u00e7\u00e3o da Instru\u00e7\u00e3o Normativa n\u00ba 1.888\/2019, a Receita Federal instituiu a obrigatoriedade de prestar informa\u00e7\u00f5es relacionadas \u00e0s opera\u00e7\u00f5es praticadas com criptoativos \u00e0 Receita Federal.
